Zhou Bo, Partner of Fangda Law Firm: Legal Challenges and Response Strategies Faced by Flexible Employment | WISEx2020 New Human Era Summit
On August 5, 2020, 36Kr successfully held the "WISEx2020 New Human Resources Era Summit" in Shanghai, inviting domestic human resources industry entrepreneurs, experts and scholars to jointly explore the ways and techniques to break through this billion dollar market in the post pandemic era.
What are the legal challenges and coping strategies faced by flexible employment? Zhou Bo, a partner at Fangda Law Firm, believes that flexible employment is not a new phenomenon, but has gradually gained attention due to the outbreak of cost reduction needs in enterprises caused by the epidemic and the gradual acceptance of remote work models. However, there are still many legal difficulties caused by "lack of legal basis" that need to be solved through a systematic project.
Today's event is for professional friends from different industries and fields to share and approach this issue from different perspectives, allowing us to collide and spark some ideas. My own field is related to labor and personnel laws. In the past six months of the epidemic, we have encountered many problems related to flexible employment or flexible employment, including those from traditional large Fortune 500 companies, new startups, and even state-owned enterprises. During the process, we have also accumulated some experience and insights. Today, I will share with you the topic of "Legal Challenges and Countermeasures Faced by Flexible Employment".
The main content consists of three parts. Firstly, what is flexible employment? Everyone is talking about flexible employment, flexible employment. We are also discussing government policies ourselves, but no one has provided a precise definition of what flexible employment is. What does it actually mean in law? What challenges does our flexible employment face within the existing legal framework or environment? Enterprises often ask lawyers if this is feasible and if there are any risks involved in doing so. Some entrepreneurs may also ask, 'Can you help us evaluate the risks involved in this human resources service model or business direction, lawyer?'. When considering issues, lawyers can only explore them based on existing laws and regulations. In fact, if these issues are applied to the current legal framework, there are indeed many confusions or doubts. The three possible coping strategies are just some ideas we mentioned from the perspective of lawyers. Of course, human resources is not just a legal matter, it involves the government, enterprises, millions of workers, and the people themselves. This is a matter that affects everyone.
